On April 29th, my wife and I were one of three parties who submitted an offer to purchase 1007 Tobermory Way. Jenna Franze was the listing agent for this property and accordingly, reviewed and advised her clients on each of our three confidential and legally binding offers. The following day, the three bidders were advised that no offer had been accepted and new bids would be reconsidered at 6 PM that evening. We were absolutely stunned to then learn that Jenna Franze, the former listing agent, was also going to bid on this property after setting the listing price and gaining a full understanding of her competition for the property. Evidently, she had handed the listing over to a colleague prior to submitting her own offer to purchase the property. Her offer was subsequently accepted as the winning bid. Ms. Franze’s successful offer on the home was made with the confidential information and knowledge she had gleaned from the previous offers she reviewed the night before (i.e. she knew the subjects, our initial offers, subject removal dates, etc.). Does this transaction fit the definition of a transparent process and/or ethical conduct? Did this process provide a level playing field for all competing buyers? We believe the facts here speak for themselves and that this was an egregious conflict of interest that undermined the entire transaction. I should also note that we shared these concerns via email with both Ms. Franze and her managing broker, and received no response. We shared the details of this experience with numerous real estate professionals, many of whom expressed disgust at Ms. Franze’s actions and conduct in regards to this transaction. If I were choosing a realtor to represent me in Squamish, I would take note of this if considering Ms. Franze. I can advise that parties involved in this transaction have submitted formal complaints with the BC Financial Services Authority, the governing agency responsible for the supervision and regulation of realtor conduct. We are confident that the conduct described above will be dealt with appropriately. We strongly believe that the residents of Squamish have the right to be made aware of incidents like this.

Jenna has been our real estate agent for several years, during which we have both bought and sold five houses with her. While Jenna is undoubtedly knowledgeable and experienced in real estate, my encounter raised concerns regarding her professional conduct. Jenna was initially the listing agent for the property we were interested in. After reviewing all offers, she stepped down to make her own offer, which was eventually accepted. This action, while possibly within legal confines, appeared to us as a potential conflict of interest and raised questions about the fairness of the transaction process. I believe in the importance of transparency and integrity in real estate dealings, and I felt that this particular situation lacked these elements.
